Update on New Law Requiring Businesses to Report Independent Contractors

There is a new law in Florida that requires businesses to report the independent contractors they hire.  Businesses should report these contractors to the Florida New Hire Reporting Center.  This is to help with child support collection.

Previously Florida law required employers to report newly hired employees within 20 days of hiring. This law was expanded on October 1, 2021 to also include independent contractors.

Here are the 3 things you should know:

1.  Businesses need to report individuals that they hire as independent contractors.  If you pay $600 or more cumulatively to any individual person to provide services to your business you are now required to report them.  If you are using a company to provide a service to your business you do not need to report them.

2.  You must report individuals that you will pay $600 or more from your business in the last three months of 2021.Starting in 2022 once your business has paid $600 or more cumulatively to an individual, you must report that person to the Florida Department of Revenue within 20 days.

3.  You will not receive a fine or penalty for not reporting or reporting late.

The Department of Revenue’s website for reporting newly hired employees and independent contractors can be found here.  Use Form CS-EF315 to report the information.

We hope this helps businesses understand the new law. If you have additional questions, please call the office at 407-645-4775.
